Terms of Use
1. Who may use the Services
You must be able to form a binding contract in your jurisdiction. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization. The Services are not directed to children under 13 (or the age required by your region), and we do not knowingly collect personal information from children as described in our Privacy Policy.
2. The Services
Tumbler Buddy provides tools to help you track rock tumbling stages, barrels, batches, reminders, and related information. Features may include optional online functionality (such as account sign-in and cloud storage) that requires internet access and a compatible device.
- Offline use. Core features may work without an internet connection using data stored on your device.
- Changes. We may modify, suspend, or discontinue parts of the Services with reasonable notice where practicable.
- No professional advice. The Services are for convenience and organization only. They are not professional, safety, or geological advice. You are responsible for safe operation of equipment and compliance with applicable laws.
3. Accounts and security
If you create an account (for example, through our authentication provider), you agree to provide accurate information and to keep your credentials confidential. You are responsible for activity under your account. Notify us promptly at support@hrdnoxlabs.com if you suspect unauthorized access.
4. Subscriptions and purchases
Some features may be offered as paid subscriptions or in-app purchases processed by Apple (App Store) or Google (Google Play). When available:
- Payment. Charges are processed by the platform provider subject to its terms. We do not store your full payment card details.
- Renewal & cancellation. Subscriptions may renew automatically until you cancel through your platform account settings.
- Refunds. Refund requests are governed by Apple’s or Google’s policies; we do not guarantee refunds except as required by law.
- Price changes. We may change pricing with notice as required by the applicable store and law.
5. License to you
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Services for your own non-commercial or internal purposes, in accordance with documentation we provide and applicable store rules.
6. Acceptable use
You agree not to:
- Violate any law or third-party rights.
- Attempt to reverse engineer, scrape, probe, or stress-test the Services except as allowed by law.
- Upload malware, interfere with networks, or access accounts or data without permission.
- Use the Services to build a competing product using our proprietary materials.
- Misrepresent your identity or affiliation.
7. User content
You may submit content such as notes, labels, or photos (“User Content”). You retain ownership of your User Content. You grant HRDNOX a worldwide license to host, store, process, and display User Content solely as needed to operate and improve the Services, including security and support. You represent that you have the rights needed to grant this license. We may remove content that violates these Terms or that we are required to remove by law.
8. Intellectual property
The Services, including software, branding, and documentation, are owned by HRDNOX Labs or our licensors and are protected by intellectual property laws. Except for the limited license above, no rights are granted.
9. Third-party services
The Services may integrate third-party services (for example, authentication or cloud infrastructure). Your use of those services may be subject to their terms and privacy policies. We are not responsible for third-party services we do not control.
10. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, HRDNOX LABS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HRDNOX LABS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US$50), IF YOU HAVE NOT PAID US.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
12. Indemnity
You will defend and indemnify HRDNOX Labs and its affiliates against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Services, or your violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.
13. Termination
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or if we must do so to comply with law. Provisions that by their nature should survive will survive termination.
14. Governing law and disputes
These Terms are governed by the laws of the United States and the State in which HRDNOX Labs is organized or principally operates, without regard to conflict-of-law rules. You agree that courts in that State have exclusive jurisdiction, subject to mandatory consumer protections in your country of residence where applicable. Confirm your preferred venue with counsel.
15. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms with a new effective date and, where required, provide additional notice (for example, in-app or by email). Continued use after the effective date constitutes acceptance of the updated Terms.
